Terms and Conditions
These terms and conditions of Adsmarketing Solutions Ltd, providing Affiliate Services (hereinafter referred to as the "Service"), aim to inform affiliates about the rules and conditions for using the Service. They regulate the relationships between partners (affiliates) and advertisers, as well as the conditions for performing advertising activities in exchange for appropriate remuneration. The terms are designed to ensure maximum transparency and protection for all participants in the process.
1. Introduction
The use of the Service is subject to these Terms and Conditions, as published and updated on the Affigator.com platform. By registering and using the Service, you agree to the latest version of these Terms, including any policies related to commission payments and advertising activities.
2. Definitions
- Advertiser: A legal entity using the platform to generate conversions through online advertising conducted by affiliates.
- Affiliate/Partner: An individual or entity that uses the Service and platform to generate predefined actions (conversions) for Advertisers in exchange for a commission.
- Commission: The agreed payment made to affiliates by advertisers for each approved conversion generated through the platform.
- Platform: The technical system developed and managed by Adsmarketing Solutions Ltd, available at Affigator.com.
3. Registration and Profile
To use the Service, you must register on the platform. By registering, you confirm that:
- You are over 18 years old and are either an individual or a legal entity registered for marketing activities.
- You provide accurate, up-to-date, and complete information about your identity and media channels.
- You will use the profile solely for purposes related to the Service, in compliance with these terms.
Each user may create only one profile. Duplicate profiles or profiles with inaccurate information may be deactivated by Adsmarketing Solutions Ltd.
4. Online Media and Advertising Tools
Affiliates may use only pre-approved online media for advertising. The use of the following is prohibited:
- Sites with pornographic content or promoting violence, discrimination, or illegal activities;
- Sites that infringe intellectual property rights;
- Pop-up or aggressive advertising methods;
- Sites misleading users about the content of the advertisement.
5. Rights and Obligations of Affiliates
Rights:
- To use the platform and advertising tools in compliance with these terms;
- To receive commissions for approved conversions;
- To participate in promotional campaigns organized by Adsmarketing Solutions Ltd.
Obligations:
- To provide accurate and complete information about your identity and media channels;
- To comply with the terms of the advertisers and the platform;
- To use advertising tools solely for legitimate purposes;
- To promptly notify of any changes in personal or financial information.
6. Rights and Obligations of Adsmarketing Solutions Ltd
Rights:
- To verify affiliates' compliance with these Terms;
- To block or terminate access to the Service for violations;
- To update the Terms and notify affiliates through the platform.
Obligations:
- To ensure the proper functioning of the platform and tools;
- To pay commissions for approved conversions within the specified deadlines;
- To provide transparent information about generated conversions.
7. Commissions and Payments
Conditions:
Commissions are calculated and approved based on:
- Conversions generated by affiliates and registered through the platform;
- Advertisers' commission policies;
- Successful completion of predefined actions.
Payment:
Payments are made on the 25th of each month for commissions exceeding a minimum threshold of €50. Payments are processed via the bank account provided by the affiliate.
8. Amendments to the Terms
Adsmarketing Solutions Ltd reserves the right to amend these Terms at any time. Changes will be published on the platform and take immediate effect. Affiliates who disagree with the changes may terminate their use of the Service by written notice.
9. Data Protection
All personal data processing complies with Regulation (EU) 2016/679 (GDPR). The platform’s privacy policy can be found here.
10. Termination
Affiliates may terminate their use of the Service at any time by sending a written notice to [email protected]. Termination becomes effective within five business days.
11. Force Majeure
Adsmarketing Solutions Ltd is not liable for non-performance caused by force majeure events such as natural disasters, war, or platform disruptions. Affiliates will be notified of any such circumstances and measures taken.
12. Governing Law
These Terms are governed by the laws of Cyprus. Any disputes will be resolved by the competent courts in Cyprus.
